Canadian Anti-Spam Legislation (CASL) comes into effect today (July 1st 2014) and over the last few days we’ve received several inquiries from customers wanting to know if their EZLeadCapture autoresponder is CASL compliant.
The answer is YES. EZLeadCapture utilizes a double opt-in autoresponder system that requires your prospect actually take a conscious action and click the confirmation link in your confirmation email. They must complete this action before you can send them any email. We also store the timestamp and IP address of the prospect when they opt-in and also the timestamp and IP address when they click the confirmation link.
Many CASL experts seem to agree that this is enough for implied consent.
With our opt-in triggers system your website visitors must actually take an action first before the opt-in form even shows, making it an even better choice for collecting your opt-ins. There are still a few additional steps you can take to protect yourself and this is by providing very clear and concise information to your prospects.

If your marketing and advertising is targeting Canadian residents than it would be wise to add some additional information to these parts of your marketing funnel.
#1. ADD a notice on your confirmation page telling your Canadian subscribers that by clicking on the link in your confirmation email they will be giving you consent to continue emailing them until such a time they remove themselves. (see the example above)
#2. ADD a notice in your confirmation email stating the same as above. If the prospect see’s this message twice before they confirm their email it’s much harder for them to say you didn’t ask for their permission, especially if they make a false complaint against you.
#3. DO add your full business name and address to out-going emails from our autoresponder system. CAN-SPAM already requires this. CASL does too.
#4. DO utilize the automatic removal system. If a prospect clicks on your removal link at the bottom of an email they will be removed immediately and purged from the system entirely after 24 hours.
For most businesses who’ve been practising ethical email marketing (double opt-in confirmation) for a few years then CASL is not that big of a deal… If you’re using Internet Marketing “trickery” that dupes people into subscribing for email they never wanted to receive then you’re going to have big problems if someone complains.

- Auto Selected “Subscribe Me To Your Newsletter” Check Boxes.
- Co-Registration (signing people up for other offers in addition to your own)
- No Physical Address In Outgoing Emails.
- Misleading Subject Lines.
- Unclear Confirmation Processes.
- Not Including Unsubscribe Mechanisms.
With fines for individuals as high as $1 million dollars and corporations up to $10 million there is great incentive to make sure you are CASL compliant.
